Licensee’s User Consent to Provision and Processing of Personal Data under the License Agreement

This consent to provision and processing of personal data of the licensee’s user (hereinafter, the “Consent”) under the license agreement has been developed in accordance with the laws of the Russian Federation.
By submitting his/her personal data for personalized use of the Antiplagiat System® software by filling out the registration form,
the licensee’s user consents to the provision and processing of personal data (hereinafter, “PD”) by the PD processing operator and copyright holder of the Antiplagiat System® software, Antiplagiat Joint-Stock Company (Antiplagiat JSC: OGRN (Primary State Registration Number) 1057747076078, INN (Taxpayer Identification Number) 7705664677, KPP (Tax Registration Reason Code) 773101001, 42 Bolshoy Boulevard (Skolkovo Innovation Center), Building 1, Floor 0, Premises No. 111, Workplace No. 11, Moscow 121205, e-mail: dpo@antiplagiat.ru, hereinafter, the “Operator”).
The licensee’s user hereby:
- consents to the Operator using the software of the companies listed as “Personal Data Processing Operators” on the Operator’s website at https://www.antiplagiat.ru/partners when receiving and processing PD;
- confirms that all PD submitted by the user for authorization in Antiplagiat System® are accurate and belong to the user;
- confirms and acknowledges that the user has carefully read the text of the Consent in full and has understood its meaning;
- consents to the Operator processing PD without reservations and restrictions;
- fully consents to the Operator processing PD via using automation tools (computer devices and software);
- agrees to bear all risks associated with the provision of inaccurate PD;
- confirms that by providing the Consent, the user acts solely on behalf of its employer/customer (the licensee), and has not been mislead.
The Consent is accepted when the licensee’s user checks the appropriate box upon the first entry into the personal account in Antiplagiat System® (hereinafter, the “Account”). The request is generated immediately after the licensee user checks the appropriate box in the login form on the Website and clicks on the button to submit the data marked as “Log in” when entering via e-mail.
If the licensee’s user refuses to submit PD and does not consent to their processing, the licensee’s user will be unable to access the Antiplagiat System® software due to technical impossibility of the remote use of Antiplagiat System®.
The Operator accepts and processes PD to:
- perform under the license agreement under which the licensee’s user acts;
- ensure interaction of the licensee’s user with the Antiplagiat System® software;
- generate and deliver results of using the Antiplagiat System® software to the licensee’s user;
- provide other information at the request of the licensee’s user.
The Operator:
- collects and processes the minimum required amount of PD within the minimum period of PD storage and processing permitted by the laws;
- warrants that PD will be stored and processed only in the Russian Federation;
- communicates that PD are processed automatically by computer equipment and software, without permanent access to PD by the Operator’s specialists;
- is not liable for any inaccuracy in submitted PD;
- is not liable for personal information that may appear in the texts checked by the licensee’s user for plagiarism by the Antiplagiat System® software, since this does not constitute an instance of providing personal data to the Operator.
Categories and list of processed PD
The licensee’s user consents to the Operator processing the following PD:
- first name, last name, patronymic, telephone number and e-mail address of the licensee’s user;
- technical information that is automatically transmitted by the computer device of the licensee’s user when interacting with the Antiplagiat System® software (information on the licensee’s user browser, IP address, cookies, hardware and software, time of access to the Antiplagiat System® software and technical data related to its use);
- information on the licensee’s user received from the Operator’s partner under agreements.
During PD processing, the Operator may perform any actions with PD established by the applicable laws of the Russian Federation to the extent necessary for the specific purposes of the licensee’s user for interacting with the Antiplagiat System® software.
PD are not transferred to any third parties, except for persons processing PD on behalf of the Operator and in other cases established by the applicable laws of the Russian Federation.
Term of the Consent, PD destruction procedure
The Operator will store PD until the Account is deleted.
The licensee’s user may revoke the Consent by submitting a written request to the Operator. The Consent revocation will not affect the legality of PD processing until the Operator accepts the Consent revocation.
If the licensee’s user revokes the Consent, personalized access to the Antiplagiat System® software will be lost.
Information on the licensee’s user may be deleted by the licensee’s user via the functionality of Antiplagiat System®.
The Operator will delete PD of the licensee’s user in the following cases: 1) upon a written request of the licensee’s user accepted by the Operator upon agreement with the Root Administrator of the system; 2) upon termination of the license agreement under which the licensee’s user interacts with the Antiplagiat System® software, or 3) if the licensee’s user violates the terms of the license agreement or the Consent.
The licensee’s user may contact the licensee’s System Administrator to delete personal information (PD) from the Account.
Within ten business days from the receipt of the request from the licensee’s user, the Operator will provide the licensee’s user with information (PD) as a personal data subject. The Operator may extend the said deadline by no more than five business days after notifying the licensee’s user and stating reasons for extending the deadline for providing the requested information.
This Consent is valid from the moment of submission of PD, but not longer than the term of the license agreement under which the licensee’s user interacts with the Antiplagiat System® software, and may be revoked by the licensee’s user at any time by submitting a written request to the Operator addressed to the CEO of Antiplagiat JSC at: 42 Bolshoy Boulevard (Skolkovo Innovation Center), Building 1, Floor 0, Premises No. 111, Workplace No. 11, Moscow 121205, Russian Federation.
If the licensee’s user revokes the Consent, the Operator may continue PD processing on the grounds specified in Clauses 2-11 of Part 1 of Article 6 and Part 2 of Article 10 of Federal Law No. 152-FZ “On Personal Data”.
The Consent of the licensee’s user is specific, informed, voluntary, substantive and unambiguous. The licensee’s user acknowledges the Consent as a document executed in simple written form.
The Operator may amend the Consent at any time without notifying the licensee’s user by posting the updated version of the Consent on the Website.
In case of any issues regarding PD, the licensee’s user must contact the Root System Administrator.
If the Root System Administrator is unable to resolve the issues, the Root System Administrator will contact the Operator.
